These terms govern your use of scoutstreak.com, the public marketing website operated by ScoutStreak LLC ("ScoutStreak", "we", "us"). The ScoutStreak mobile application has its own end-user license agreement, presented and accepted at first launch. Nothing on this site constitutes an agreement to use the application.
1. Marketing site only #
This website exists to describe ScoutStreak, collect launch-list signups, and provide legal and contact information. It is not a paid service, does not host athlete data, and does not facilitate any recruiting communication.
2. Acceptable use #
You agree not to attempt to disrupt the site, scrape it at a rate that materially affects its availability, submit fraudulent or spam launch-list entries, or use it in violation of any applicable law.
3. Intellectual property #
The ScoutStreak name, wordmark, color system, copy, and visual design are the property of ScoutStreak LLC. You may link to the site freely. You may not republish, mirror, or reproduce material from the site without written permission, except as permitted by fair use.
4. Disclaimer of warranties #
The site is provided "as is" and "as available". To the fullest extent permitted by law, ScoutStreak disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
5. Limitation of liability #
To the fullest extent permitted by law, ScoutStreak LLC and its members, officers, employees, contractors, and affiliates are not liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of this site, even if we have been advised of the possibility of such damages. Our total aggregate liability for any direct claim arising from this site is limited to one hundred U.S. dollars ($100).
6. Third-party links #
Some pages link to third-party services (e.g. our launch-signup API endpoint). ScoutStreak is not responsible for the content, accuracy, or practices of those third parties.
7. Governing law #
These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws provisions. Any dispute will be brought in the state or federal courts located in Kane County, Illinois, and you consent to the personal jurisdiction of those courts.
8. Changes #
We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site after a revision constitutes acceptance.
